Cyber Saathi^TM is an initiative of the Founders, intended to provide pro bono information and knowledge for the personal use of the User. The website and the contents therein are made available at no cost to User.

This agreement is binding on User and requires mandatory compliance by User. Users are required to strictly comply with the terms contained herein, which forms part and parcel of the User Terms of Usage. User is the user of this website, as defined in the Terms of Usage Agreement. Terms not defined herein shall carry the same interpretation, as in the Terms of Usage (“User Agreement”) and in the absence thereof to general usage and parlance. References to Cyber Saathi shall mean and include its founders, Board, directors, representative, officers, employees, agents and assigns. Cyber Saathi is an initiative of its Founder at present and is not a registered entity. Reference to board and directors are not intended to mean or infer the presence of a registered entity and any such reference may be read in a limited context.

Neither Cyber Saathi nor any persons associated therewith shall be responsible or liable for any breaches, violations or intrusions by third parties or for any special, consequential, punitive, direct or indirect loss or damage to any User either because of reference to or use of the website or pursuant to sharing of information therein. The entire purpose of the website is altruistic and intended to help Users and availing of the website shall therefore be at the risk and consequences of User. User shall be expected to proceed with use of this website including for submission of queries or other inputs subject to the above. User shall read and affirm this Privacy Policy in full, as well as the entire Terms of Usage and Copyright Policy, before proceeding with usage of the website. By continuing to use the website, User shall be deemed to have read, agreed to and accepted the terms of usage, copyright policy and the privacy policy hereunder including any modifications or amendments thereto.

The entire website design and development, as well as the services and tools required to set up, host, allow usage and run the same has been provided by M/s. Jemistry Info Solutions LLP. Due effort and care have been taken including through strong security protocols for protection of data submitted on Cyber Saathi website. Neither Cyber Saathi nor any persons associated therewith shall be responsible or liable for any breaches, violations or intrusions by third parties. User may proceed with use of this website including for submission of queries or other inputs subject to the above. Please read and affirm the Privacy Policy in full before proceeding with usage of the website. By continuing to use the website, User shall be deemed to have read, agreed to and accepted the terms of usage, copyright policy and the privacy policy hereunder.

PRIVACY POLICY TERMS

User Covenants

User shall not share any content which is illegal, offensive, harmful or injurious to the website or to other persons. Any information submitted by User shall be handled in accordance with applicable laws and provisions including with respect to data protection. In particular User shall not host, display, upload, modify, publish, transmit, update or share any information that

(a) belongs to another person and to which the user does not have any right to;

(b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

(c) harm minors in any way;

(d) infringes any patent, trademark, copyright or other proprietary rights;

(e) violates any law for the time being in force;

(f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

(g) impersonate another person;

(h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

(i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.

User may refer to or use the contents and knowledge – based information hosted on the Cyber Saathi Website without sharing any personal or sensitive personal information or data. Provision of the option to submit a query or to share stories is for the sole purpose of benefitting the User.

If User voluntarily provides personal or sensitive personal information on the website, to get the benefit of guidance from the Cyber Saathi team, the same is solely at the sole risk and consequences of User. The website is intended as a free resource to help and assist User to become aware of cyber threats and vulnerabilities and to gain knowledge of cyber laws. It is not intended for marketing, soliciting or professional purposes.

User shall ensure that no content that is not permitted to be shared on online platforms including the list set out above, are shared on the Cyber Saathi website.

User understands that Cyber Saathi is an altruistic initiative and any sharing of personal or sensitive personal data or information by the User is solely for the benefit of the User. User also acknowledges that any such information or data shared through the website will not be visible for public and that it is intended solely for seeking further guidance from Cyber Saathi and its team at no cost. User agrees, acknowledges, affirms and consents that Cyber Saathi and its team shall not, for any reason whatsoever, be liable or responsible for any loss, damage or third – party breaches thereto. Whilst all care and precautions have been taken by Cyber Saathi User is cautioned that all technology and devices are susceptible to attacks and breaches and hence User is advised to exercise caution in the sharing of any information or data through the Cyber Saathi website.

User shall indemnify and hold harmless, Cyber Saathi, its founders, Board, directors, representative, officers, employees, agents and assigns from and against any claim, decree, order, judgment, charge, penalty, liability, damage, loss, cost, or expense (including attorneys’ fees) incurred by Cyber Saathi or its Founder due to the User’s commissions or omissions, suppression of information, submission of false information, negligence, infringement of proprietary rights or content, gross negligence, misconduct, or abandonment of its obligations. In the event of initiation of legal proceedings, User shall ensure defense of any claim by counsel of Cyber Saathi and / or its Founder’s choice. Settlement of any claim shall not bind Cyber Saathi or its founders, Board, directors, representative, officers, employees, agents and assigns, if the same creates any liability on them. Cyber Saathi, its founders, Board, directors, representative, officers, employees, agents and assigns shall not be responsible or liable to User for any loss, harm, damage, breach, disclosure or misuse or abuse of the content submitted online by User due to third party hacking, breach, introduction of computer contaminant or any other illegal or violative action. User understands and accepts that Cyber Saathi and its founders, Board, directors, representative, officers, employees, agents and assigns shall not be liable for damages or loss of any nature whatsoever including consequential, special, incidental, indirect or punitive damages for any reason whatsoever. User understands and accepts that sharing of the content is solely for the purpose of availing of help from Cyber Saathi and that no liability whatsoever shall lie against the website or persons or entities associated therewith.

Cyber Saathi affirms that it shall not use the information or data submitted by User for profiling or marketing to the User or for commercial purposes. The only use that content submitted would be used is to extend inputs and guidance to the User and for research, case study, testimonial or reference purposes. User agrees and affirms that Cyber Saathi may use the details of the User’s personal and sensitive personal information to avail of grants or financial support for the initiative. Cyber Saathi has taken help of professionals for effective technology enabled tools for protection of the data submitted but the same is within the control of such third-party hosting, server and storage service provider. Cyber Saathi may periodically (and in any event once a year) review content received and delete all content for submissions, where the purpose of such submission is no longer relevant. Cyber Saathi will not retain details of the clarifications or query posted beyond the period of its relevance. It is however clarified that the details of the User and general details of the purpose will be retained in perpetuity or till such time as Cyber Saathi deems essential for statistical purposes. User agrees and confirms its acceptance of the said terms.

Cyber Saathi has, at its cost, availed of hosting, server and storage facilities in India and to its knowledge no part of the content is being transferred outside India. Cyber Saathi is intended to be a free resource intended to help Users and to create awareness on cybercrimes, cyberlaws and policies. Cyber Saathi is a non-profit initiative. Cyber Saathi therefore does not extend any warranties, guarantees or undertakings to User for accessing or availing of the website though Cyber Saathi has taken all efforts to ensure due protection and care for User submitted personal / sensitive personal information and data.   User may further note that cloud storage services may be in any part of the World. Details of the website design and hosting service provider are shared on the website of Cyber Saathi. User has read, agrees and consents to the User’s personal or sensitive personal data and information residing on such third-party hosting and storage servers.

User shall ensure that all data and information shared with Cyber Saathi is true, accurate, correct and complete. Cyber Saathi will not be held liable or responsible for any incorrect information provided by the User to Cyber Saathi. User may seek verification of personal or sensitive personal details with Cyber Saathi for the purpose of reviewing and / or correcting the same. User shall ensure that all such additions or modifications shall also be true and accurate. User may write to Cyber Saathi for recall of consent and for deletion of User’s query submissions and such request shall be dealt with, as per applicable laws. User may submit the query by email (_______) or through the website for such verification of contents and / or for seeking deletion. The same shall however not affect actions undertaken or data and information collated or technological processes initiated prior to such withdrawal of consent. It is however unequivocally accepted that User’s name, date of access and usage of the website and the fact of submission of a query shall be retained for period, at decided by Cyber Saathi and the same may be used for demonstrating the work of Cyber Saathi or its impact.

Information collected from Users:

1. Cyber Saathi may collect various kinds of personal and sensitive personal information about User, including, name, age, phone number and email addresses and the submissions may include sensitive personal information. Each of these are intended only for the benefit of User and not for any other purpose. data collected as above shall not be used for marketing purposes but only for the purpose of rendering the assistance limited to that which is set out herein above by Cyber Saathi.
2. User is required to only share information voluntarily. Reference to the Website and to its contents does not require any registration or submission of personal or sensitive personal information.

• User access of the website will however be captured and such data retained in perpetuity or at the discretion of Cyber Saathi. Where User has location services activated, the website may receive such information. User may therefore verify and ensure additional privacy measures, as User deems fit and proper;

1. Additional User information based on meta data or logs will be available with Cyber Saathi for its use and reference.
2. Whilst using the Cyber Saathi website, the website may collect information of the actions taken by the User while using or interacting with the site.
3. The said information collected is incidental and necessary for the functioning of the website.

Sharing of Information:

1. Cyber Saathi will not share any of the confidential information submitted by User to third parties, except to those engaged for responding to the queries of User.
2. Any further use, sharing or retention shall be for the sole purpose of improving the quality of information and knowledge on Cyber Saathi or for use as case study or for research purposes.

• Cyber Saathi shall not use User name in any case study or for its research purpose. The sole purpose of use shall be to help others not fall victim to similar frauds or violations.

1. Cyber Saathi does not intend to commercialise or use User data in any manner. It may however use the data submitted by User for validating the effectiveness of Cyber Saathi, its efficacy and to demonstrate the number of persons who have benefitted from the value offered through Cyber Saathi and its initiatives.
2. Cyber Saathi may submit itself to various audits including a technology and technical and legal audit. During such audits information (personal or sensitive) submitted by User may be disclosed to such audit professionals. Cyber Saathi shall take best efforts to ensure that such professionals or third parties adhere to the confidentiality provisions contained herein.

Disclosure of Information:

1. Cyber Saathi will share data and information if called upon by Court or Government authority, as is mandated in law. Any such disclosure shall not amount to a violation of the confidentiality provisions set out herein;
2. In the event of any error, technical problems or rectification of the website, server it is hosted on or pursuant to the various software or licenses purchased for developing the website, there may be disclosure of data from the website to third parties. Cyber Saathi shall take best efforts to ensure that all such third parties are also bound by confidentiality provisions and limitations on purpose, retention and deletion of such content;

• Any sharing intended to investigate, diagnose, correct, and/or resolve a technical issue shall not amount to violation of any of the terms contained herein;

1. All information provided on the Cyber Saathi Website shall be subject to the applicable Privacy Policy;
2. Cyber Saathi shall not be responsible for the content, privacy, or security practices and policies of third parties and does not extend any warranties or assurances or guarantees with respect thereto.

Information shared with third parties and our service providers:

1. User is hereby informed in full of the use by Cyber Saathi of third parties for developing this website, hosting of the same, storing of information provided by User on third party storage facilities; possibility of use of cloud storage by such third party and of such cloud storage being fungible and possibly even outside the boundaries of India. is under no obligation to become involved in disputes between Users on the site, or between Users on the site and any third party.
2. User may continue to use the website and avail of the information contained therein and / or submit queries, stories or publications subject to such disclosure. Continued usage of the website by the User shall be deemed to be consent for such sharing of their personal and sensitive personal information and data with third parties;

• The User shall be bound by the terms of service of such third parties to the same extent as Cyber Saathi would be bound. Cyber Saathi shall however not be responsible or liable for any commissions or omissions by such third parties including with respect to data protection or compliance with applicable laws and regulations with respect thereto.

Security and Safety of User information:

1. Cyber Saathi is an independent, not-for-profit organization focusing on cyber safety in digital spaces offering free access to information and knowledge resources online for the benefit of users.
2. Whilst Cyber Saathi takes due care and caution in providing appropriate security measures it cannot be held liable for any reason whatsoever for any breach and / or short comings in the services provided.

• Users are cautioned that no method of transmitting information over the Internet or storing information is completely secure. Cyber Saathi thus cannot guarantee the absolute security of any information.

1. Cyber Saathi will take appropriate legal, administrative, physical, and electronic measures designed to protect the information that is collected from or about user from accidental or unlawful destruction, accidental loss or unauthorized access, use, modification, interference, or disclosure.
2. Cyber Saathi shall not be liable however for any loss, damage, disclosure, breach or violation of such personal or sensitive personal information submitted by User including a minor (with parental consent as mandated) either through third party illegal acts, unforeseen events or accidents, limitations in technology or technical measures taken, force majeure (which includes act of god, pandemics, floods, earthquakes, natural calamities, viruses, hacking, denial of service attacks, ransomware attacks, technology enabled crimes against the Cyber Saathi website or any other unforeseen or insurmountable reason or occurrence).

Collection of Data:

1. Cyber Saathi affirms and confirms that it does not seek any sensitive personal data from User except the access data for using or accessing the website;
2. Any user data submitted is only for the purpose of the benefit of user and will be used only in a lawful, fair and transparent manner;

• The data will be used only for the purpose submitted by User which includes for case study and research purposes;

1. Cyber Saathi has taken all effort to ensure that only such data, as is needed is collected and has restricted the same to the minimum requirement;
2. Cyber Saathi has taken all measures to ensure that data submitted is accurate by mandating User to affirm accuracy an truth of the data submitted. In the event that any third party data is submitted and such third party brings errors to the notice of Cyber Saathi, the same shall be addressed and corrected at the earliest;
3. Cyber Saathi intends to retain sensitive personal data only for the purpose it is submitted. Queries and responses will be retained for a period of ONE Year from the date of submission or lesser period based on need of User. Cyber Saathi shall however retain data pertaining to the number of users who have accessed the website; their personal details to demonstrate correctness of the numbers; and purpose of visiting site for the sole purpose of their records to evaluate the efficacy of the website and its contents; to seek support for continuation of the website and the benefits accruing therefrom to users and to avail grants and support for the initiative.

• Cyber Saathi has taken all efforts at its personal cost to extend sufficient integrity and confidentiality for the data submitted for availing pro bono benefits of Cyber Saathi. Such personal cost having its limitations Cyber Saathi cautions User to only share such information as is essential for them to get the benefit of the website and no more. Cyber Saathi does not encourage User to share personal or sensitive personal data or information and any such submission is at the sole discretion and for the benefit of the User;
• Cyber Saathi will take efforts within its limited resources to hold any third parties who may have access such information accountable. It shall also direct third parties to delete such information upon completion of their work or rendering of services to Cyber Saathi.

Privacy

1. User data furnished to Cyber Saathi shall be subject to the terms of the Privacy Policy of Cyber Saathi, as periodically revised or amended. User is deemed to have consented to the Privacy Policy, by reading and accepting these terms.
2. User hereby consents to the collection, storage, use, sharing and disclosure of User’s personal and sensitive personal information, as per the terms of the Privacy Policy.
3. In the event that the User wishes to retract the consent herein furnished, the User may do so by discontinuing use of the Cyber Saathi website and also writing to Cyber Saathi to delete any submissions or queries made. However the access data of such User of the website will be retained for the purposes set out herein above.
4. Reading and consenting to the terms herein and those set out in the Privacy Policy are mandatory for continued use of the Cyber Saathi website.

Confidentiality

1. User recognizes that Cyber Saathi will be given and have access to confidential information including but not limited to sensitive personal information provided by the User.
2. User hereby agrees and consents to use of such confidential data and information by Cyber Saathi.
3. Cyber Saathi will take best efforts to keep such information confidential and not to disclose to any third parties except in the course of its business or for marketing, analytical and for processing of such data.
4. This limitation shall however not apply to
   1. data already in the public domain;
   2. data already within the knowledge or information of Cyber Saathi or its team;

• furnishing of data in pursuance of a request from a legal or regulatory authority or order from a Court;

User Affirmation of Terms & Conditions

User affirms having read and accepted all the terms and conditions of usage of this site including the terms of this Privacy policy. User confirms that all contents provided are true and correct. User confirms that use by Cyber Saathi, of the content or information provided by User, may be used as a case study, testimonial or for research purposes and such use does not amount to a breach or violation of the rights of User or of any confidentiality mandate.

Cyber Saathi reserves the right to periodically review and revise this Privacy Policy. User is required to periodically review terms and any changes thereto. Continued use of the Cyber Saathi website constitutes agreement of User to the terms contained herein, including any amendments and modifications made hereto.

All other provisions of the Cyber Saathi Terms of Service, Copyright Policy and disclaimer and other notices submitted by User, shall be read into this policy and shall form part hereof, including Governing Laws, Dispute Resolution and jurisdiction. User agrees, accepts and confirms that User has read, reviewed and understood the terms herein and for use of the website and by using this site, the User consents unconditionally to the terms of usage, copyright policy and privacy policy and such or other terms and conditions set out herein.
